We reserve the right to change our pricing with at least 30 days’ notice. Existing subscribers will be notified by email before any price change takes effect.
The Service, including its software, design, documentation, and branding, is owned by ToggleKit Ltd and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
You retain ownership of any content you submit to the Service (such as URLs and project configurations). You grant us a limited licence to process this content solely to provide the Service to you. Screenshots captured by the Service are generated from publicly accessible web pages or pages you have authorised us to access.
We process personal data in accordance with our Privacy Policy and applicable data protection legislation, including the UK GDPR, the Data Protection Act 2018, and the EU GDPR where applicable. We aim to maintain high availability of the Service but do not guarantee uninterrupted access. The Service is provided on an “as is” and “as available” basis. We may perform scheduled maintenance with reasonable notice where possible.
Support is provided via email. Paid plans receive prioritised support. We will use reasonable efforts to respond to support requests within 2 business days.
Access to the API is subject to rate limits and usage quotas as defined by your Plan. API keys are confidential and must not be shared publicly or embedded in client-side code. We reserve the right to revoke API keys that are compromised or used in breach of these Terms.
We may update the API from time to time. We will use reasonable efforts to maintain backward compatibility within a major API version and will provide notice before deprecating any API version.
To the maximum extent permitted by law, ToggleKit Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
You agree to indemnify and hold harmless ToggleKit Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law or the rights of any third party.
We may suspend or terminate your access to the Service at any time for breach of these Terms, with or without notice depending on the severity of the breach. You may terminate your account at any time by contacting us or using the account settings in the dashboard.
Upon termination, your right to use the Service ceases immediately. We will retain your data for a limited period as described in our Privacy Policy to allow for account recovery or to comply with legal obligations.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where possible.
We may update these Terms from time to time. Material changes will be notified by email or by posting a notice on our website at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in this clause affects your statutory rights as a consumer under applicable law.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy and any plan-specific terms, constitute the entire agreement between you and ToggleKit Ltd regarding the Service. They supersede any prior agreements or understandings, whether written or oral.
